VOLUNTEER RELEASE OF LIABILITY and PHOTO RELEASE

                                       HANDS ON HOUSING

1.    The below named volunteer will be working with Hands On Housing as performing volunteer services for Hands On Housing in connection with various types of community service activities.  Hands On Housing hereby releases and discharges the Volunteers from any and all liability or responsibility for any accident or injury to person or property which may occur during the course of such community service activities, except for any liability or responsibility resulting from the negligence, recklessness, or willful misconduct of the Volunteers.  Volunteers hereby release and discharge Hands On Housing and any of its directors, officers, employees, partners, affiliates, successors, assigns, agents and volunteers (collectively, the “Hands On Housing – Related Parties”) from any and all liability or responsibility for any accident or injury to person or property which may occur during the course of such community service activities, except for any liability or responsibility resulting from the gross negligence or willful misconduct of the Hands On Housing – Related Party claiming release.

2.    Volunteers hereby agree to indemnify and hold harmless the Hands On Housing – Related Parties from and against any damage, claim, loss, liability or expense incurred in connection with or arising out of any accident or injury to person or property which may occur during such community service activities as a result of Volunteer’s negligence, recklessness, or willful misconduct, except for any damage, claim, loss, liability or expense resulting from the gross negligence or willful misconduct of any Hands On Housing – Related Party seeking indemnity.

3.    Each provision of this Release shall be valid and enforceable to the fullest extent permitted by law, and the invalidity or non-enforceability of any portion of this Release shall not affect the validity or enforceability of any other portion.

4.    The person signing this Release on behalf of Hands On Housing represents that she/he is duly authorized to so act.

5.    This Release embodies the entire agreement and understanding between the parties hereto with respect to the subject matter hereof.  The parties hereto represent that prior to signing this Release they read it, understand the terms and conditions, were given an opportunity to consult with counsel, and voluntarily signed it.  This Release may be modified, waived, discharged or terminated only by written instrument signed by the parties hereto.

6.    I also give my permission to Hands On Housing to take still photos or video of me.  I further give my permission for the photos or film to be used as Hands On Housing deems appropriate for publicity and fund raising, and I understand they will not be used by anyone else for any other purpose other than to further Hands On Housing’s mission.
